The questions presented by this appeal concern alleged errors in the presentation of evidence and in charging the jury.. By amended information defendant was charged with the commission of crimes committed on January 5th and January 22d, 1945, respectively. Counts 1 and 2 charged the robbery on January 5th of Mrs. Carrie Ellingson of $639.87 and of Ray R. Byrnes of one package of cigarettes of the value of 15 cents. Counts 3, 4 and 5 charged the murder on January 22d of Virgil Marques, robbery of Leonard E. Brown of $425, and assault upon said victim with a deadly weapon with intent to commit…
