Appeal from a judgment of the County Court of Schoharie County (Bartlett, III, J.), rendered April 28, 1999, convicting defendant upon his plea of guilty of the crime of murder in the first degree.
On May 12, 1997, Frank Arroyo was shot and killed at his residence in Schoharie County. The investigation focused upon the victim’s estranged wife, Donna Arroyo, her boyfriend, Cary McKinley, and defendant, McKinley’s stepbrother.
