OPINION OF THE COURT

Rose, J.

Defendant was indicted on two counts of murder in the first degree and two counts of murder in the second degree based on allegations that he intentionally shot and killed his parents on March 26, 1996 in the family’s home in the Town of Richfield, Otsego County. Defendant was also indicted on several unrelated charges in Otsego and Herkimer Counties. On October 4, 1996, the last day of the 120-day period for filing a notice of intent to seek the death penalty (see, CPL 250.40), and without such notice having been filed, defendant entered a counseled plea of guilty…
