The parties to this suit appear here in the inverse order in which they appear in the trial court. They will be referred to herein as plaintiff and defendant in the order in which they appeared in the said court.

W. E. Bennett is the owner of a promissory note for $658 due June 23, 1923, and executed by J. Winfield Scott, and the said Bennett claims also that he was at one time the legal and equitable owner and holder of certain collateral to said note, to-wit, a certain promissory note for $4,000 made by R.
