MEMORANDUM AND ORDER DENYING IN PART UNITED STATES TRUSTEE’S MOTION TO DISMISS

The United States Trustee’s Motion to Dismiss Pursuant to Section 707(b) 1 is currently pending before the Court. Debtors David Dewayne Close, Jr., and Jada Kathleen Close appear by counsel Cynthia F. Grimes. The United States Trustee (“UST”) appears by David P. Eron. The UST seeks dismissal first for presumed abuse under 11 U.S.C. § 707(b)(2).
