— This is an action by appellee against appellant to recover damages sustained by him, by reason of personal injuries to his minor child, Valley M. Perry, alleged to have been inflicted on account of the negligence of appellant. The complaint alleges, and the evidence establishes, the following general facts: That a public highway known as Sycamore *508street extends north and south through the east part of Gaston, in Delaware county, intersecting practically at grade appellant’s railroad in the southeast part of the town.
