I. INTRODUCTION
On October 24, 2008, the undersigned United States District Judge heard oral argument on Plaintiff Gregory Wersal’s (“Wersal”) Motion for Summary Judgment [Docket No. 37] and the above-captioned Defendants’ (“Defendants”) Motion for Summary Judgment [Docket No. 26].
