This is a suit instituted by appellee, primarily against the railroad company, Duval West, receiver, Word Lee, and J. E. Franklin to recover the sum of $10,539.56 for grading and constructing a portion of the roadbed of said railroad. The pleadings cover 42 pages of the transcript; the second amended petition, on which the cause was tried, having been filed on the day the cause was tried. In that petition A. R.
