It appears herein, from a statement in one of the briefs, which is stated in the other to be substantially correct, that the defendant in error was, during a few months of the year 1874, and prior thereto, the wife of John H. Underwood, who died during the year 1874 in Virginia, where he and his wife were then residing. The plaintiff in error, the daughter of the couple, was born about three months after the death of the father.
