The facts necessary to an understanding of this case are briefly as follows: Some years ago, in the district court of Buffalo county, John Johnson sued Marcus L. Parrotte at law for damages for the latter’s alleged misrepresentation of some sheep sold by him to Johnson, who had a verdict^ and Parrotte filed a motion for a new trial.
