This is an action of the case for deceit, “brought originally in the District Court of the Sixth Judicial District, in which decision was rendered for the plaintiff, and is now before us on defendant’s exceptions to the rulings of that court.(1) The bill of exceptions sets forth that at the trial in the District Court evidence was adduced in behalf of the plaintiff that the defendant falsely represented to him that the defendant was the owner of certain real estate; that the plaintiff •did not know who was the owner of it, and, relying on the defendant’s representation, was induced to enter…
