OPINION

SAND, District Judge.

Plaintiff Tony Burton, committed to the custody of the New York State Department of Correctional Services (“DOCS”), brings this action pursuant to 42 U.S.C. § 1983, alleging that Defendants, each of whom is or was at the relevant time a DOCS employee, violated his federal constitutional rights. Before this Court is Defendants Girod Cordell, Superintendent William J.
