WALES, District Judge.
This suit is brought under the provisions of section 1915, Rev. St. The plaintiff claims to he the first inventor of a process for lining wood-pulp digesters, and filed his application for a patent March 7,1889. On April 26, 1890, Hermann Brungger, claiming to be the original inventor of the same or a similar process, filed three applications for patents. On April 14, 1891, an interference was declared by the commissioner of patents.
