This is an action brought by Pundt to recover damages for personal injuries alleged to have been suffered by him while in the- employ of the construction company.

In the first trial a verdict for- plaintff in the sum of $8,000 was returned by the jury, but set aside by the court. The plaintiff preserved a wayside bill of exceptions.

The last trial resulted in a verdict and judgment for $9,000. The defendant company preserved its bill of exceptions, and prayed an appeal.
