1Opinion of the CourtBailey, J.
On July 20, 1932, the plaintiff, while employed by Hudson-Duncan & Co. (hereinafter to be mentioned as the Hudson company), in the state of Oregon and in the course of such employment, was injured. At that time neither he nor the Hudson company was subject to the Oregon Workmen’s Compensa tion Act. However, there was then in force covering the Hudson company a standard workmen’s compensation and employer’s liability policy of insurance which prior to the date of the accident had been issued to the Hudson company by the defendant.
