OPINION

HORN, Judge.

This case comes before the court on the defendant’s motion for summary judgment, pursuant to Rule 56(c) of the Rules of the United States Court of Federal Claims *497(RCFC). The defendant contends that the court should grant summary judgment in favor of the defendant because there are no genuine issues of material fact in dispute, and the defendant is entitled to judgment as a matter of law based on the absence of an enforceable contract.
