Preparatory to building a mule stable in an old entry-way in one of its mines, appellant took the timbers out of the roof, leaving a space about thirteen feet square and from twelve to thirteen feet high at the highest point, above which was about four hundred feet of rock and earth. This space which had been timbered about twenty years before, was first used as a lye or switch and later as a gob room where refuse dirt and rock were placed.
