The appeal in this ease presents the question as to whether defendant bank as escrow holder was obligated to return to plaintiffs certain corporate stock and documents which had been deposited with it pursuant to a contract of sale. Intervener (buyer) contends that his duty to deposit in escrow the consideration for the purchase of the shares was dependent upon performance of all conditions imposed upon plaintiffs (as sellers) and that the latter have not fully performed.
