COMPTON, Chief Justice.
This is an appeal from a judgment for the defendant in a wrongful death action and for damages for loss of personal property.
The complaint alleged that the defendant was negligent in repairing, or in failing to repair, faulty brakes on a used Galion road grader before delivery to the plaintiff, Bar-tie Renfro, thereby breaching its express and implied warranties of fitness; that such negligence was the proximate cause of the accident in which decedent was killed.
