BRICE, Justice.

This is an appeal from a judgment in favor of the appellee (plaintiff) and against thé appellants (defendants) . for damages because of the alleged negligent killing of plaintiff’s intestate. The appellant Hayes will be styled defendant and the appellant Insurance Company will be styled Insurance Company in this opinion.

Plaintiff’s intestate, while riding a bicycle at an intersection of two streets in the city of Albuquerque, was struck and killed by an automobile driven by the defendant. The defendant, it is alleged by plaintiff, was an employee of the Insurance Company, and…
