DEVIN, J., took no part in the consideration or decision of this case. R. O. Jeffress, of Haywood County, N.C. died on 10 November, 1922, having first made and executed a last will and testament, which was duly admitted to probate in the said county of Haywood in the office of the clerk of the Superior Court of said county.
