HERLONG, District Judge.

This matter is before the court with the Report and Recommendation of United States Magistrate Judge William M. Ca-toe, Jr., made in accordance with 28 U.S.C. § 636(b) and Local Rule 73.02 DSC. 1 The United States alleges that the $57,960.00 is subject to forfeiture under 21 U.S.C. § 881(a)(6). The claimant, David Anthony Babb (“Babb”), proceeding pro se, contends that he is the lawful owner of the subject property. A number of motions have been filed and are pending before the court.
