MEMORANDUM & ORDER
PAULEY, District Judge.
In this diversity action, plaintiff Federal Insurance Company (“Federal”), an excess liability insurer, alleges that defendant Liberty Mutual Insurance Company (“Liberty”), a primary insurer, acted in bad faith by failing to offer the maximum coverage of its policy to settle a lawsuit. Liberty moves for summary judgment dismissing the complaint. For the reasons set forth below, Liberty’s motion for summary judgment is granted.
