CROW, Judge.

This is an appeal from a judgment of the Circuit Court of Jasper County in a quo warranto proceeding.1

David C. Dally, in his official capacity as Prosecuting Attorney of Jasper County, instituted the proceeding against Stephen Holt, County Collector of Jasper County.

Rule 98.02(a) provides that the party seeking relief in a quo warranto proceeding is relator, and the person against whom relief is sought is respondent. Consequently, in the trial court Dally was relator and Holt was respondent. However, as explained infra, the case has now reached this court by appeal taken by Holt.…
