This case involves a summary judgment that was affirmed by this court on all but one of the plaintiffs claims upon which the defendants had failed to move for summary judgment; this court reversed and remanded the summary judgment as to that claim. Reynolds v. Murphy, 188 S.W.3d 252, 275 (Tex.App.-Fort Worth 2006, pet. denied), cert. denied, — U.S. —, 127 S.Ct. 1839, 167 L.Ed.2d 323 (2007).
