In this certified zoning appeal, the defendant, the planning and zoning commission of the town of Monroe (commission), appeals from the judgment of the trial court sustaining the appeal of the plaintiff, Smith Brothers Woodland Management, LLC. The commission denied the plaintiffs application for a special exception permit to make improvements to its landscape mulch processing operation on real property it owns in Monroe.
