MEMORANDUM ON TRUSTEE’S OBJECTION TO DEBTOR’S CLAIM OF EXEMPTION IN ERISA-QUALIFIED PENSION BENEFIT PLAN

The debtor, Patrick F. Messing, claims an exemption in the amount of $6,365.45 in an ERISA 1 -qualified pension benefit plan established by his employer. 2 The exemption is claimed under Tennessee law pursuant to Tenn.Code Ann. § 26-2-104(b) (Supp. 1989). Alternatively, the debtor claims the exemption under 11 U.S.C.A. § 522(b)(2)(A) (West 1979 & Supp.1990).
