This action was commenced to recover damages suffered by plaintiff when struck by an automobile alleged to have been driven by the defendant Cerald Doyle. From a verdict and judgment for the defendant the plaintiff appeals.
Plaintiff testifies that on January 1, 1936, at or near the hour of 12:30 a. m., he was walking south across Norfolk avenue on the west side of First street in Norfolk, Nebraska.
