This action was brought in the United States District Court for the District of Kansas by appellee, William A. Atteberry, to review a decision of the Secretary of Health, Education and Welfare (HEW), appellant, denying Atteberry’s claim for Social Security disability benefits on a 1957 application for the reason that due to lapse of time the decision was final and could not be reopened.
