Marvin Wittier appeals the district court’s order affirming the Secretary of the Department of Health and Human Services’s determination that he was not entitled to continued disability benefits because he was participating in a vocational rehabilitation program. Wittier argues that even though he is no longer disabled, he is entitled to continued benefits under section 301 of the Social Security Disability Amendments, Public Law 96-265, codified at 42 U.S.C. §§ 425(b) and 1383(a)(6). 1 The ALJ concluded that Wittier was not entitled to continued benefits…
