OPINION

FONES, Justice.

Appellant, Divorce Referee of Shelby County, appeals from a declaratory judgment validating, “for reasons of equity and comity”, a divorce awarded by a court in the Dominican Republic.

On November 21, 1974, Eleanor Lentz Hyde was awarded a decree of divorce by the Court of First Instance of the Judicial District of Santo Domingo, Dominican Republic. She appeared in person and was represented by an attorney. Joseph R. Hyde, III, was not personally present but was represented by his attorney in fact, by virtue of a power of attorney filed with the Court. These appearances…
