It is alleged in the complaint, in substance, that prior to the 16th of November, 1884, the defendant, whose name was then Harry Gurensky, and one Harry Gurensky, were, as co-partners, engaged in business in San Antonio, Texas, under the firm name of H. & H. Gurensky; that plaintiff sold and delivered to H. & H. Gurensky goods of the value of $1,536.84; that on the 16th of November, 1884, the co-partnership of H. & H. *411Gurensky was dissolved; that on such dissolution the defendant assumed and agreed to pay the plaintiff $768.17, one-half of the…
