MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Plaintiff Robb Container Corporation (“Robb”) sued Sho-Me Company (“ShoMe”), Elmer C. Lynn (“Lynn”), Marco Products, Inc. (“Marco”), Robert Beckwith, Jr. (“Beckwith”) and General Packaging Technologies, Inc. (“GPT”) for unfair competition, passing-off, trade disparagement, breach of contract, breach of fiduciary duty, common law trademark infringement, deceptive trade practices and conspiracy to interfere with contractual relations.
