This suit in equity was instituted by Oliver Bagby on the 27th day of August, 1907, for the purpose of determining the interest of the defendants Freeman E. Hertzel, Theodore N. Barnsdall, and Howard Weber to and in certain trust fund moneys which accrued from the operation of two oil leases and came into his hands as an officer of the Vinita & Chelsea Oil Company. The controversy is entirely between Plertzel and Barnsdall on one side and Weber on the other. There is no controversy over the amount of the fund held by Bagby, the manner it came into his hands, or the validity of the oil leases…
