The first assignment of error relied upon by defendant is predicated upon the court’s admission, over objection, of testimony adduced by plaintiff for establishing an alleged oral agreement between the parties in modification of the original contracts of leasing, and the instructions of the court submitting to the jury the question whether such an agree*766ment had In fact been entered into.
