Appeal from a judgment of the Superior Court of Humboldt County, and from an order denying a new trial. The facts are stated in the opinion of the court, and in the opinion of Mr. Commissioner Hayne.

A rehearing was granted in this case after a decision by the court in Bank reversing the judgment and order of the superior court.
