SULLIVAN, Judge:

On July 22, 1988, this Court issued its decision in United States Navy-Marine Corps Court of Military Review (hereafter CMR) v. Carlucci, 26 MJ 328 (CMA 1988). On September 12,1988, the Solicitor General filed with the Supreme Court an application for an extension of time within which to file a petition for writ of certiorari in the above case.
