DECISION

LEWIS, Senior Judge:

The appellant pleaded not guilty to attempted rape and premeditated murder committed while attempting to perpetrate the offense of rape. Both murder theories (premeditated and felony murder) were alleged in one specification. He was found guilty following a trial before members. These findings, having been announced as unanimous for murder, subjected the appellant to a possible capital sentence. R.C.M. 1004(a)(2).
