OPINION OF THE COURT

JOHNSON, Judge:

Sergeant Gill was charged with assault consummated by a battery on a child under the age of 16, assault in which grievous bodily harm was intentionally inflicted, and unpremeditated murder.1 The victim was his infant daughter, who died at the age of 4 months. A general court-martial, composed of members, found Sergeant Gill not guilty of murder but guilty of assault consummated by a battery on a child under the age of 16 and of two specifications of aggravated assault with a means likely to cause grievous bodily harm.
