This case is before the court on appeal from a judgment of the Toledo Municipal Court.

From such material as appears in the record, the following account states the essential facts. Appellant, Colleen Porter, leased an apartment from appellee, William Miller. Her apartment is one of four such units in a two-level house, located at 339 East Broadway Street. She resides in the lower right-front unit facing East Broadway Street.
