Plaintiffs Bruce and Frances Wenner, husband and wife, bring this action against their bank, Bank of America, NA, (“BOA”). This case is before the court on three motions: (1) plaintiffs’ motion to amend their complaint to add a claim under the Kansas Consumer Protection Act (“KCPA”) (Doc. 32); (2) plaintiffs’ motion to amend their complaint to add BOA’s credit card division, FIA Card Services, N.A.
