This is an appeal from an order dismissing a suit instituted to obtain a declaratory judgment as to the validity of Reissue Patent No. 22,241, a second reissue of the reissued patent before this court in United States Industrial Chemicals, Inc., v. Carbide & Carbon Chemicals Corp., 4 Cir., 121 F.2d 665, and later before the Supreme Court, 315 U.S. 668, 62 S.Ct. 839, 86 L.Ed. 1105. Plaintiff is incorporated in New York and defendant in Delaware.
