The defendant was indicted for having, in the county of Galveston, on the 19th of March, 1874, established “ a lottery, under the name and denomination of ‘ The Galves- “ ‘ ton Gift Enterprise Association,’ for the purpose of dispos- “ ing of corporeal personal property, and money, by lottery.” The trial resulted in a verdict of guilty, and the assessment by the jury of a fine of one hundred dollars.
