This is an action to recover income and excess profits taxes alleged to have been illegally and erroneously assessed to and collected from the plaintiff taxpayer. It is before this Court upon the motion of the defendants for leave to amend their answer and upon the motion of the plaintiff for summary judgment. Each motion is opposed.
