This case was referred pursuant to Rule 57(a) to Trial Commissioner Herbert N. Maletz, with directions to make findings of' fact and recommendation for conclusions of law. The commissioner has done so in an opinion and report filed on June 29, 1965. Plaintiff filed no exceptions or brief to the report. On July 28, 1965, defendant filed a brief excepting in part to the commissioner’s opinion and recommendation for conclusions of law.
