Defendant appeals from an order denying its motion for a new trial.
Defendant, a fraternal beneficiary association organized and existing under the laws of the state of Ohio and authorized to do business in Minnesota, issued its contract of accident insurance (hereinafter called “policy”) insuring A. O. Garbush, husband of plaintiff, against disability or death resulting from bodily injuries “effected through external, violent and accidental means.” Plaintiff is the sole beneficiary named in the policy.
