This action is on an implied contract for the value of the pasturage of cattle and horses. The complaint alleges the ownership and right of possession of the lands in the plaintiff; the ownership of the cattle and horses in the defendant; that the lands were inclosed by substantial fences; that the defendant broke into and entered on to the lands and caused his cattle and horses to be pastured thereon during a specified period of time; that the pasturing was of the reasonable value of $1.50 per head per month, amounting to the total sum of $266.25.
