MEMORANDUM OPINION AND ORDER

GETZENDANNER, District Judge:

Plaintiff Michael Toney has brought this action pursuant to 42 U.S.C. § 1983 to challenge the constitutionality of an Illinois statutory and regulatory procedure which authorizes defendant Roland Burris, Comptroller of the State of Illinois, to withhold certain portions of a state employee’s wages if the defendant ascertains that the employee is indebted to the state.
