This is an appeal from a judgment rendered by the district court of Muskogee county, in an action brought by L. O. Hunt to recover $363.60 allegedly due from defendant, H. H. Seval, on an open account, running from August 12, 1925, to July 7, 1944.

Plaintiff originally filed his action in the city court, where defendant had judgment, and an appeal was taken to the district court.
