Reid, Chief Justice.

Richard Smith and Raymond Carter were jointly indicted for the murder of T. H. Herd, and upon the separate trial of Richard Smith he was found guilty, without recommendation, and was sentenced to be electrocuted. His motion for new trial having been overruled, he excepted, assigning error on that ruling, on the general grounds of the motion, and on two special grounds which complained of the admission of certain testimony, and of a refusal to order a mistrial in connection with certain statements by a witness.
